Terms of Service

These terms set out the agreement between you and Esse Mobility when you use the GreenWheels rider app, the GreenWheels Driver app or this website. Please read them carefully: by creating an account or using our services you accept them.

1. About these terms

Esse Mobility (“we”, “us”) provides the GreenWheels service in Nigeria. These terms apply to riders, drivers and parents or guardians who book school runs. Drivers also agree to the extra terms in section 10.

Our Privacy Policy explains how we handle your personal data and forms part of these terms.

2. Your account

  • You must be at least 18 years old to create an account.
  • The information you give us must be accurate and kept up to date.
  • You may hold only one rider account and one driver account, and you must not share them.
  • Keep your password and sign-in codes private. You are responsible for activity on your account; tell us straight away if you think someone else has used it.

3. Our service

GreenWheels connects riders with drivers for trips and school runs. Some drivers use their own car; others drive a GreenWheels fleet car assigned to them by us.

We work hard to keep the service available, but we can’t promise it will always be available, error-free or that a driver will always be nearby. Arrival times and trip durations are estimates.

4. Booking and cancelling rides

  • Before you book, the app shows the fare for your trip. The final fare can change if you change the destination, add stops, or the trip takes much longer because of your request.
  • Be at the pickup point on time. If you cancel after a driver has accepted, or the driver can’t find you, a cancellation fee may apply. Any fee is shown in the app before you are charged.
  • Treat drivers and their vehicles with respect, wear a seat belt and follow the driver’s reasonable safety instructions.
  • Drivers may refuse or end a trip if a rider behaves unsafely or unlawfully.

5. Payments and your wallet

  • Rides and subscriptions are paid from your GreenWheels wallet. You add money to it inside the app by saved card, new card, bank transfer or USSD. Payments are processed by Paystack.
  • Minimum and maximum top-up amounts, daily limits and any fees are shown in the app before you pay.
  • Top-ups appear in your wallet once the payment is confirmed. To protect against fraud, money you add may need up to 7 days before it can be withdrawn.
  • Withdrawals are paid to the verified bank account in your name and are confirmed with a one-time code we email you.
  • If a payment is disputed or charged back, we may hold the related wallet while we investigate.

Saved cards

You can choose to save a card for one-tap top-ups. By doing so you authorise us to charge that card, through Paystack, each time you confirm a top-up with it, including when you use “Top up and book”. You can remove a saved card at any time from your wallet.

Refunds

If you were charged incorrectly, report it in the app or email support@essemobility.ng. Approved refunds are returned to your wallet unless the law requires otherwise.

6. Subscriptions

GreenWheels plans are paid from your wallet. The price, benefits and length of each plan are shown in the app before you buy. A plan’s benefits apply only while it is active.

7. Safety

We check drivers’ identity, licences and vehicles before they can drive, show riders who is coming and let you follow the trip live, call or message without sharing your number, and use safety cameras in some fleet vehicles. Fleet drivers can request a replacement battery with Battery SOS.

Report any safety concern in the app or to support@essemobility.ng. In an emergency, call 112 first.

8. Things you must not do

  • Use the service for anything unlawful, or to carry illegal or dangerous items.
  • Harass, threaten, discriminate against or harm anyone.
  • Damage a vehicle or leave it in a condition that needs special cleaning.
  • Give false information, impersonate someone or create accounts for others without permission.
  • Misuse promotions, payments or refunds, or try to defraud us, riders or drivers.
  • Copy, reverse-engineer or interfere with our apps, website or systems.

9. School runs

If you book a school run, you confirm that you are the child’s parent or legal guardian, or are authorised by them, and that the details you give us are correct. You agree that drop-off updates and photos are shared with the guardians and teacher contacts you add.

10. Extra terms for drivers

  • You must hold a valid driver’s licence, pass our checks and keep your documents, vehicle papers and insurance up to date.
  • Obey traffic laws, drive safely and never use your phone in a way that puts anyone at risk.
  • For each trip you earn the fare minus the GreenWheels commission and any levies, as shown in the trip’s breakdown in your earnings.
  • Earnings are paid out to the verified bank account you add, using in-app withdrawals.
  • If you drive a GreenWheels fleet car, use it only for GreenWheels trips and as we direct, look after it, and report damage, faults or a low battery promptly.
  • We may suspend or remove access if your documents lapse, your ratings stay low, or you break these terms.

Unless you have a separate written agreement with us, using GreenWheels Driver does not make you our employee.

11. Ratings and feedback

Riders and drivers can rate each other after a trip. Ratings help keep the service safe and reliable, so please rate honestly and fairly. We may remove feedback that is abusive or unrelated to the trip.

12. Promotions and partner offers

The apps show promotions from GreenWheels and selected partners, always labelled. Promo codes and offers have their own conditions, shown with the offer. Partner offers are provided by the partner, who is responsible for them.

13. Our content

The GreenWheels name, logos, apps, website and their content belong to Esse Mobility or our licensors. You may use the apps only for their intended purpose and may not copy or reuse them without our written permission.

14. Our responsibility to you

We provide the service with reasonable care and skill. To the extent Nigerian law allows, we are not responsible for losses that were not foreseeable, for delays caused by events outside our control, or for the actions of riders, drivers or third parties that we could not reasonably prevent.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your rights as a consumer under Nigerian law.

15. Suspending or closing an account

You can delete your account at any time in the app (see our Privacy Policy for how deletion works). We may suspend or close an account if these terms are broken, to protect someone’s safety, or if the law requires it. Where it is safe and lawful, we will tell you why and give you a chance to respond.

16. Changes to these terms

We may update these terms as our services or the law change. If the changes are significant we will tell you in the app or by email before they take effect. If you keep using the service after that, the new terms apply.

17. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria. If you have a complaint, contact us first so we can try to put things right. If we can’t resolve it together, the Nigerian courts will have jurisdiction.

18. Contact us

Questions about these terms can be sent to support@essemobility.ng.
